I'd see what could be done to fix it. Take some pictures to a welding shop and see if they could do a repair. At least you'll have a price to compare your options. Dodgy sellers are not known to be easy to find even if a court of law does uphold your contract. You can win a court case against them (god knows how much that would cost but probably far more than the value of the goods) but then trying to collect your money back when you cant find them or they do...
